Court Rules France Telecom Tax Breaks were Illegal

­France Telecom has been ordered to repay around EUR 1 billion (US$1.5 billion) of illegal state aid back to the French government. The actual ruling is for between EUR798 million and EUR 1.14 billion, but also includes interest charges since the state aid was offered.  more

Lithuania Warned Over Providing Mobile Location of Emergency Callers

The European Commission has sent a formal warning to Lithuania calling on it to ensure that the location of people calling the single European emergency number 112 from their mobile phones is made available to emergency services. Lithuania could be fined if the case proceeds to the European Court of Justice again.  more

European Court Ruled Dutch Operators Colluded on Sales Commissions

The European Court of Justice has ruled that a single meeting can be used to presume that an illegal cartel exists between companies, and that local regulators are able to apply fines when that occurs. The ruling comes from an incident in 2001, when the five Dutch mobile network operators are accused of colluding to lower commissions paid their retailers.  more

Italy Urged to Provide Mobile Location Services for Emergency Calls

Caller location information is still not available to emergency services from all mobile 112 calls in Italy, as required by EU rules, despite a judgement from the European Court of Justice in January calling on Italy to make this happen. The European Commission has now decided to send a letter of formal notice to Italy requesting it to comply with the judgement and to ensure that caller location information is available to emergency services for all 112 calls.  more

Bouygues Telecom Loses 3G License Appeal

The European Court of Justice has ruled that the French government was correct in retrospectively lowering the 3G license fees it charged to France Telecom and Vivendi's SFR. In 2000, the French government sold two 3G licenses to France Telecom and SFR for EUR4.95 billion each. A later attempt in 2002 to sell the remaining two licenses raised just EUR619 million from Bouygues Telecom. The fourth license remains unsold to this day.  more

O2 Loses Legal Action Against Hutchison 3G UK

The European Court of Justice (ECJ) has ruled that Hutchison 3G UK did not breach trademark law when it used a marketing icon belonging to rival UK operator, O2 in one of its advertisements. O2 uses bubble images in a host of ways and is the proprietor of two British national trade marks which consist of a static picture of bubbles.  more

Polish Regulator Says Mobile Costs Dropped Sharply in 2005-2007

Poland's telecoms regulator has published a report into the cost of mobile phone services in the country, and concluded that the average mobile prices offered by domestic mobile operators were characterised by a substantial drop within the period from 2005 to 2007. With respect to tariffs offered by the Polish operators compared to operators from other EU Member States, Poland witnessed one of the most significant drops in tariffs within the period from 2005 to 2007 for the post-paid basket (36%) as well as for the post-paid and pre-paid jointly (36%).  more

Setback for O2 in Hutchison 3G UK Trademark Dispute

A legal opinion from the European Court of Justice has found that the use of a competitors trademark in an advertisement is permitted under EU advertising rules. The decison comes from an appeal by UK operator O2 over the use of its "bubbles" trademark in an advert by rival operator, Hutchison 3G UK.  more
