The company, though its Free branded subsidiary had argued that the auction rules would hurt the company to a degree that would be illegal, or reduce the market competitiveness to a similar degree.
The company had tried to also argue that the requirement for the licenses to be paid for in full at the time of award put smaller companies at a competitive disadvantage. The judge rejected the claim.
The French government is expecting to be able to raise at least EUR2.5 billion from the auction that will take place in two stages starting next week.
