Wi-LAN Wins Patent Dispute Against Ericsson

Patent troll, Wi LAN says that it has won a court fight with Ericsson over the proper interpretation of a contract signed between the two companies.

Although Wi-LAN did not elaborate in detail about the contract, it related to the breadth of patent rights assigned to Ericsson, which Wi-LAN had interpreted as narrower than Ericsson thought they were.

The court agreed with Wi-LAN's interpretation of their contract where Wi-LAN had agreed not to sue Ericsson over four patents relating to 3G technologies, but did not grant Ericsson "most favored licensee" status for any other patents it might acquire in the future.

Wi-LAN had argued that the narrow interpretation was necessary to avoid a conflict of interest after retaining a former Ericsson advisor to assist it in asserting its rights over a batch of HSPA patents.

"We are very pleased with this ruling," said Jim Skippen, President & CEO. "We hope this decision brings Ericsson closer to a negotiated resolution of our patent disputes."
