Apple Loses Bid to Ban Samsung Phone Sales in the USA

Apple has lost an attempt to ban the sale of some older Samsung smartphones in the USA.

U.S. District Judge Lucy Koh in California ruled that while Apple showed patent infringement by Samsung, it had not shown that the patents were sufficiently significant in within the Samsung devices to warrant a sales ban.

Although the phones are no longer sold by Samsung, a sales ban could have had impact on any other phones the company releases in the future that are demonstratively too similar to the older models.

The ruling could also be a precedent setting set-back for Apple as it prepares to make a similar argument later this month which will be seeking a similar sales ban on newer Samsung smartphones.

In a statement, Samsung said it was pleased with the ruling. "We ... agree with its observation that a few software features alone don't drive consumer demand for Samsung products - rather consumers value a multitude of features,"

Apple has not commented.
