Vodafone Petitions Indian Court to Block 900Mhz Spectrum Sale

­Vodafone India has filed a petition in the Delhi High Court to stop the government selling off 900Mhz radio spectrum that the company is currently using.

Vodafone agues that its existing license includes a clause offering them the right to extend their licenses for a further 10 years when they expire. However, the Department of Telecoms is recalling the spectrum instead with the intention to sell it in an open auction.

Vodafone said in its petition that it believes that it is entitled to a fair and reasonable extension of its license and the unilateral action of DoT to auction the 900 MHz which is already allocated, held and being utilized by Vodafone without discussing, considering and deciding on its extension application is arbitrary and confiscatory in nature.

The mobile network added that it is currently using the spectrum to provide services to around 18.7 million customers, out of its total 150 million customers.
