US ITC to Review Patent Infringement Allegation Against Samsung
Published on:
The USA's International Trade Commission (ITC) is to review a decision taken last October which had found that Samsung was infringing two of Apple's patents.
It is fairly rare for the ITC's panel of judges to send an earlier Administrative Judge report back for consideration. The Administrative Judge had found that Samsung had infringed two patents, but not two others in a complaint filed by Apple back in the middle of 2011.
One of the patents being reviewed allows the use of a headset with a smartphone. The other patent permits a device to show an image on a screen with another, translucent image overlaying it.
The US ITC has become one of the key battlegrounds in the ongoing tit-for-tat patent wars because they have the power to ban imports of devices into the USA if found to infringe on patents. That impact is often greater than potential fines awarded by courts in lawsuits.
The decision in this case was due to be announced in March, but is now expected to be pushed back by a couple of months.
