Apple Lawyer Denies Smoking Crack Cocaine in Court Hearing
Published on:
Apple's lead lawyer in the Samsung patent lawsuit was asked if he was smoking crack yesterday - by the Judge. The quip came after the company said it wanted to approve a 75-page briefing and call 22 new witnesses in the case.
Both companies were limited to 25 hours of argument in the lawsuit by Judge Lucy Koh, and both companies are nearly out of time.
When Apple attorney William Lee made the request, the Judge retorted that no lawyer would present such a request at this point in the proceedings and said that "unless you're smoking crack you know these witnesses aren't going to be called"
As conversations in the court are transcribed - the Apple lawyer swiftly put on the formal record that he had not been smoking crack. He was adamant though that they could question the 22 witnesses in the remaining four hours allocated to them.
Samsung is down to less than half an hour of time allocated to it.
In related news, the two companies also clashed over the profit margins that Samsung has earned on its products sold in the USA.
Apple claimed that Samsung had profit margins of around 35%, while Samsung claims it is closer to 12%. Samsung's accountant claimed that Apple's calculations omitted several key costs, including its marketing budget, of which not a single cent was allocated.
Apple is seeking US$2.5 billion in damages and a ban on sales, while Samsung is countersuing for patent infringements of its own.
