Apple Loses Tablet Design Lawsuit in the UK
Published on:
Samsung has won a pyrrhic victory over Apple in their ongoing dispute about the design of their respective tablets.
Apple argues that Samsung's tablets are copies of its iPad, and has sued in numerous countries. Now a UK High Court Judge has ruled that Samsung's products cannot be mistaken for Apple's - because they lack the necessary cool factor.
The Judge wrote that Samsung's Galaxy Tab devices "do not have the same understated and extreme simplicity which is possessed by the Apple design." As such, he ruled that consumers were not likely to confuse the two.
"They are not as cool," he added. "The overall impression produced is different."
Samsung welcomed the ruling: "Should Apple continue to make excessive legal claims in other countries based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited."
Apple has 21 days to appeal against the ruling.
