Apple Fails to Block Imports of HTC Smartphones into the USA

Apple has failed to secure an emergency ban on sales of HTCs newest smartphone after the U.S. International Trade Commission (ITC) refused a request to impose the ban.
Apple claimed in its submission that HTC is violating an order issued last December and wanted imports of the HTC One X and EVO 4G seized by US customs.
HTC had already suffered sales delays in May when some of its shipments were held up by US Customs who had to check the smartphones to ensure they did not breach the restraining order. However, HTC was able to persuade the customs officials that the patent in dispute was not used in their new phones.
Apple is now disputing the claim and says that HTC has continued to infringe the patent, which related to discovery of phone numbers within emails so that the number can be stored in a phone memory without being dialed first.
Responding to the request, the ITC wrote that it "finds that Apple has not demonstrated the propriety of temporary emergency action here," adding that it will "not direct Customs to detain all subject HTC products because the commission does not have the information necessary to determine whether the respondents are currently violating the commission's limited exclusion order."
