Apple Loses IPad Design Copyright Lawsuit in Spain

Apple has lost a lawsuit against a small manufacturer of Android tablets that could have repercussions in the company's battle with the vastly larger Samsung Electronics.
The small Spanish manufacturer of Android tablets, Nuevas Tecnologias y Energias Catala confirmed that it had won a legal battle initiated by Apple who had demanded that the company cease production of its NT-K tablets. Apple had claimed that they looked similar to its iPad - an argument that the company is using against Samsung's tablets.
The dispute is similar in scope to that between Apple and Samsung, and which Apple so far seems to be winning. Samsung's lawyers can be presumed to be pouring over the Spanish ruling to see if it can be expanded to cover the entire of Europe.
According to a statement by the company, Apple was able to secure an import ban on the tablets into Spain in November 2010, and commenced legal action the following month when the Spanish firm refused to back-down.
The company also claimed that it was put onto a European blacklist for piracy while the case was being held and its imports seized by customs.
Having won its case, the company now says that it will seek damages from Apple for the lost sales it could have enjoyed over the past year.
