Huawei Gets Preliminary Injunction Against Motorola

Huawei says that it has been granted a preliminary injunction that prevents Motorola from transferring Huawei's confidential information to Nokia Siemens Networks.
The order also requires Motorola to hire an qualified third party to ensure Huawei's confidential information is securely removed. It also allows Huawei to audit NSN's record of service it performs on Motorola-branded system that include Huawei products.
Huawei started legal action earlier this year as Nokia Siemens Networks seeked to complete its US$1.2 billion acquisition of Motorola's wireless network business.
Since 2000, Huawei and Motorola have had a cooperative relationship in the radio access network and core network businesses, where Motorola has resold Huawei wireless network products to customers under the Motorola name. According to Huawei , during this period, Motorola was provided with products and confidential Huawei IP developed by Huawei.
Since the July 2010 announcement by NSN of its purchase of Motorola's wireless network business, Huawei said that it has tried to ensure that Motorola does not transfer this confidential information to NSN. Huawei claims that Motorola has not responded with assurances that it will prevent disclosure of that information to Nokia Siemens Networks.
In a statement, Huawei said that it is pleased that the court continues to recognize the merits of its claim that "Motorola must abide by its contractual obligations to protect Huawei's trade secrets and intellectual property."
