Court to Hear Radio Spectrum Complaint Against Reliance Communications
India's Supreme Court has admitted appeals by the Indian GSM networks trade body, COAI and state owned operator, BSNL challenging the telecom tribunal ruling that permitted Reliance Communications to offer both GSM and CDMA services over the same telecoms license.
The Telecom Disputes Settlement and Appellate Tribunal had upheld the government decision to allow the firm to use both GSM and CDMA for offering mobile services in the country, on an appeal by the Cellular Operators Association of India (COAI) challenging the decree.
The COAI had argued that the National Telecom Policy of 1999 guaranteed optimal radio spectrum to the GSM operators, and allowing the CDMA operator to enter the market breached the agreement.
