Court Accepts Lawsuit Against Movistar
A Chilean court has admitted a class action lawsuit seeking damages of US$260mn against mobile operator Movistar for alleged service quality failures, local press reported.
A group of Chilean parliamentarians led by Jaime Mulet filed the lawsuit in August on the grounds that Movistar is responsible for service failures and consequently should pay compensation to all affected users. The government officials believe Movistar could have prevented the service failures.
The lawsuit names all of Movistar's users, some 5.7mn at the end of 2006, as plaintiffs.
Movistar, a unit of Spain's Telefónica, said in an email to press that the company sees no legal grounds for the suit. Additionally, the company said that its service surpasses that which international standards and Chilean law require."
